Welcome to Trick Dash. These Terms of Service ("Terms") govern your access to and use of the Trick Dash application, website, and related services (collectively, the "Service") operated by Bunk Labs, Inc., a Delaware C Corporation ("Company," "we," "us," or "our").
By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
You must be at least 18 years old to use Trick Dash. By using the Service, you represent and warrant that you are at least 18 years of age. We reserve the right to request proof of age at any time and to suspend or terminate accounts that we reasonably believe belong to individuals under 18.
To use Trick Dash, you must create an account. You agree to provide accurate information during registration and to keep your account credentials secure. You are responsible for all activity that occurs under your account.
Trick Dash uses device-based anonymous accounts by default. If you add an email address for account recovery, we store only a cryptographic hash of your email — we never store your actual email address on our servers after the verification process.
Trick Dash is an LGBTQ+ social application that enables users to discover nearby users, communicate via messaging, and participate in community features. The Service includes two modes:
The separation between Radar and Dark Room identities is a core feature. Attempting to unmask, correlate, or expose another user's Dark Room identity is a violation of these Terms.
You agree to abide by our Community Guidelines, which are incorporated into these Terms by reference. In addition, you agree not to:
You retain ownership of content you upload to Trick Dash ("User Content"), including photos, profile text, and messages. By uploading User Content, you grant the Company a non-exclusive, worldwide, royalty-free license to host, store, transmit, and display that content solely for the purpose of operating the Service.
You are solely responsible for your User Content. The Company does not endorse any User Content and is not liable for content posted by users.
Profile photos in Radar mode are subject to automated and manual moderation. Photos that violate our Community Guidelines may be removed without notice. Dark Room content is subject to separate moderation standards as described in the Community Guidelines.
Certain features (such as Flashes and Expiring Photos) are designed to be temporary. While we make reasonable efforts to delete expired content from our servers, we cannot guarantee that recipients have not captured, saved, or forwarded content before its expiration.
Trick Dash offers an optional paid subscription ("Pro") that unlocks additional features. Pricing, features, and terms of the Pro subscription are displayed within the app at the time of purchase.
Trick Dash uses your device's location to show you nearby users. Your precise coordinates are converted to a geohash (a low-resolution geographic area) before being stored. We do not store your exact GPS coordinates on our servers. You can revoke location permissions at any time through your device settings, though this will limit the functionality of the Service.
Your privacy is important to us. Our collection, use, and sharing of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes. This license does not include the right to copy, modify, distribute, sell, or lease any part of the Service.
The Service, including its design, features, code, and branding (including the Trick Dash name and logo), is the property of Bunk Labs, Inc. and is protected by copyright, trademark, and other intellectual property laws. For copyright infringement notices (DMCA), contact dmca@trickdash.com with: (a) a description of the copyrighted work, (b) the location on our Service, (c) your contact information, (d) a statement of good faith belief, and (e) your signature.
We may suspend or terminate your account at any time, with or without cause, including for violations of these Terms or the Community Guidelines. You may delete your account at any time through the app's Settings. Upon deletion, we will remove your profile data, photos, and messages in accordance with our Privacy Policy.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not conduct criminal background checks on users. We do not verify the identity, background, or intentions of users. You are solely responsible for your own safety when interacting with other users, both online and in person.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BUNK LABS, INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING FROM YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.
You agree to indemnify and hold harmless Bunk Labs, Inc. and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your User Content, or your violation of these Terms.
Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. Arbitration shall take place in the State of Delaware. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration, to the extent permitted by applicable law.
Notwithstanding the above, either party may seek injunctive or equitable relief in any court of competent jurisdiction for urgent matters involving intellectual property or account security. Small claims court actions are also excluded from mandatory arbitration.
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the app and updating the "Last Updated" date above. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the State of Delaware, without regard to its conflict of laws principles.
The Service may contain links to third-party websites or services. We are not responsible for the content, policies, or practices of any third party. Your use of third-party services is at your own risk.
We are not liable for any failure or delay in performing our obligations due to events beyond our reasonable control, including natural disasters, internet outages, government actions, or third-party service disruptions.
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
These Terms, together with the Privacy Policy and Community Guidelines, constitute the entire agreement between you and Bunk Labs, Inc. regarding the Service and supersede all prior agreements or understandings.
Sections 5 (User Content), 9 (License), 10 (Intellectual Property), 12 (Disclaimers), 13 (Limitation of Liability), 14 (Indemnification), 15 (Dispute Resolution), and 17 (Governing Law) shall survive any termination of these Terms or your account.
